Lady with the Cats

 I had hoped that the woman who loves cats would wake up and realize that my site is not the atmosphere to place her pictures, thoughts, and ideas about cats, but she hasn't. My site is NOT the appropriate place to show her deep feelings about cats. I don't know her and due to the fact that she simply doesn't get what I'm trying to say, I feel her attitude is bordering on cruel. I'm positive she'd be able to hook up with other cat lovers and have the common courtesy to take her palette cleansing pictures, and ideas about how to raise cats off of my site.

I am not anti-cats, I am simply pro- humanity, pro-motherhood and pro-consideration. So please, if you know the story of my site and what I did, and what was done to my clients, my son and me because I refused to steal from very ill AIDS patients, ask this woman to take her cats off of my site and put her cutesy pictures on her own site. I have the intelligence and decency not to place pictures of my very ill patients on her site therefore, I'd hope she come back down to earth and leave the site as it should be, with respect and displaying an adult demeanor. On a very personal note, she has insulted me and if she knew the story or read it, she has past the line and basically insulted herself.

So, please Cat Lady, remove your pictures and cat-like pearls of wisdom, I find it beyond insulting.

Dear Angelsomi,  I understand the pain you are feeling for your child and for yourself.  Believe it or not I have been there.  I have found that you get more help from agencies like the Salvation Army than you do from receiving a dollar.  County agencies also help even though some non-profits do embezzle funds.

Thank-you for your comment.  You have no idea how much money non-profits embezzle from patients and clients.  I am a nurse, health & sex educator the the country's first AIDS Coordinator, I'm not capable of stealing from sick patients in pain, however there are people who have no problem in doing so.  I'm fortunate that OIG believed me and put the thief in federal prison.  Being the person I am however cost me everything I ever owned and loved, especially my son for over 3 years.

If I can ask anything of you, please tell everyone you know about this story. There have been articles printed and the story's been told online, but it's so shocking and upsetting people have turned their backs, I'm glad you haven't been one of them.  Blessed Be,

My Dear Friends,

What has happened to me, my son and my patients, is beyond sick and extraordinary, and please for all the people who have placed posts on my site, under no circumstances do not take this as an insult.  My site deals with HIV+ and AIDS patients, and using Family Court to create a “smoke and mirrors” effect, while obstructing justice. My clients and patients are people who had their benefits, money, medicine, and shelter stolen.  The AIDS Coalition of Volusia & Flagler Co.,Inc. took any possible quality of life they have or had left for their own selfish purposes.  They robbed my son's childhood, made him believe I was dead for 10 weeks, obstructed justice, committed Fraud Upon The Court, conspired, purged, bribed and attempted to turn me into a quivering jellyfish, aching for her child.  I was the only parent my child knew for 10 years. This was not a father interested in his child, this was a bitter jealous man finally finding a way to punish a woman who wouldn't let him abuse her or her child (infant) any longer. So after he was removed by the sheriff's department in Florida he slithered away to IL and remained there for 10 without contacting his son or helping him in any way, until the AIDS Coalition of Volusia & Flagler Co., Inc. had a special job for him because they were unable to shut me up. I must preface that by saying the AIDS Coalition of Volusia & Flagler Co., Inc. superiors watched as I was brutally assaulted twice in my own office by a subordinate co-worker. The first time a knife was used, no one came to my aid. When that didn't work, while my son and I slept on December 29, 2002, our loft was broken into and all of my discs and computer and TV was stolen. We lived @ The Breakers with three electric gates and a bar fence around the grounds, however no one saw a thing. The disc with the information about the theft, embezzlement and fraud however was in my purse under my bed. They did not get that and I was able to submit it to The Inspector General's Office who conducted the investigation and validated my allegations and more.

Not only that as you can see my son finally got the courage to make a statement, a statement not only about the way he feels, but if you read between the lines the pain his biological father, the late Larry Nixon, P.A. and the disqualified judge Richard Graham who collectively believed an unlicensed massage therapist, Neil Harper with an extensive criminal background, (which suddenly disappeared when he said I was "delusional" about my allegations of embezzlement) are apparently equivalent to  psychologists, psychiatrists and DCF therapists. The AIDS Coalition of Volusia & Flagler was the catalyst to so much pain and distraught, something my child should never have been exposed to, however these people had no problem in causing him unbearable pain. They constantly harassed me stating there would be no problems if I'd shut my mouth about the theft. This was before they brought my baby into this mess.

My son was kept from me for 3&1\2 years based on fraud, they had the information from the Inspector General's Office stating I told the truth, my allegations had been validated, and I should be thanked. However, all that time away from the only person in the world I love has been thrown away due to ego, ignorance and things I am too disgusted to think about let alone say. They handed my child over to a man (?) who abused both of us, was restrained from the house for over 18 months and then left me alone to take care of an infant, work and be completely responsible for everything, yet Volusia County, who had NO jurisdiction decided by the words of a long term criminal who never met the ex, that I was irresponsible and delusional.

I respect the right of anyone to say what they believe, however I feel it is inappropriate to place posts on this particular web-site about the love of kitties etc. It simply makes no sense to place these posts on my web-site.  So with all due respect please refrain from placing posts on this site which have nothing to do with what we went through, tried to inform the public about, while closing down the agency and making sure the embezzler, Ebony R. Davis was indicted for embezzlement and of course imprisoned @ Coleman Federal Prison.

This web-site is simply not the correct forum to discuss the issues lately that have been posted.

Alison Bowen is one of your most courageous and insightful writers, in my opinion. The custody cases in the main and reference articles today bring important factors to light. When a family is in this kind of situation, there are always people in their lives who side one way or the other, and if the neutrality and integrity of the lawyers and courts can not be counted upon, the victims in each case are even more alone. Resources can be very difficult to identify, to reach, and to know which can be trusted for fairness. When systematic bias takes place, as is reported by Bowen from Mo Therese Hannah of court lawyers in New York influencing, biasing, thousands of cases toward the father's custody I'm shocked, and I'm not easily that shocked by custody bias information. The whistle-blower case of Egan-Byron, and the bribery case of Karlene Gordon show a depth of lack of integrity that indicates a need for "housecleaning" of the court system at all levels. These are the lives of women and children who are being put at risk, and the lives of men who are able to live outside the law, thus, learning that the law is irrelevant and that women and children can be beaten and reduced to privation with impunity. The case of Holly Collins shows all the traditional problems: harms to mother and children not taken as crimes, mother believing she was the only person who experienced such a problem, staying with the father as the only available way to protect the children as the courts will not let her take the children from the father, then being punished for staying with the father, then being punished for escaping, the courts not acknowledging what a danger this man is to the children, and forcing children to spend time with this father they know to be abusive, and who begged their mother to help them get away from him, the children now not being supported by the courts, as they do not have safe passage to the U.S. unless their mother goes to jail there, and there is no guarantee they will be protected from their father. This case should have been resolved years ago, with the father being jailed, then jailed again every time he attempted to go near Heidi or the children. It is a classic example of what is happening in the thousands of cases where New York courts are blatantly siding with the father because he is the father, which many of these fathers do not deserve, and puts children at risk. I'm astounded most for the lack of consideration for the real welfare of the children. What is happening with the Voices of Women Organizing Project's call for "four recommendations: fund an independent court watch project to enforce procedures; ensure that court decisions protect children and reflect their best interest; take abuse allegations seriously and hold abusers accountable; and ensure that court proceedings are fair and just?" This, however, is a small solution, when a thorough legal inquiry into New York's divorce and custody legal system is needed, i.e., determine who is consistently biased, and get rid of them, however many of them there are. --Janet E. Reader Comment: Don't Let It Happen Again Thank you for running my story (Whistleblower Claims Custody Verdict Was Reprisal) and thank-you to Women's eNews reporter Alison Bowen for having the courage to illustrate and explain a situation no one wanted any part of (with the exception of Congressman Wexler, Chief Kenneth Donohue of OIG HUD with his agency and colleagues who knew me and my work). This can never happen again to a woman, a mother, who was simply doing her job with passion and love. Fraud and embezzlement in the workplace is sadly something many of us have been exposed to, in one way or another. But what kind of person, what kind of agency, what kind of judicial system uses a woman's child to shut her up and break her down? I hope whoever reads this story will tell everyone they know about it. One of the most horrible and destructive things in a case like this is the tendency of people to forget about it until it happens again. Unfortunately, because this disgusting scam worked so well for the embezzling agency, the judicial system and the former abusive and violent husband it surely will be copied and believe me "will" happen again. People who are so emotionally inadequate and destructive must attempt to destroy and cripple those around them who are trying to make life better for their clients, patients and their children. It makes them feel superior and above the law. But in essence what it really shows is how much they need professional help and deep down inside how little they think of themselves. I only ask that before this type of crime (on so many levels) occurs again, the system will be sincere in enforcing the promises, statutes and pledges publicized in "making the whistleblower whole again." The system must deal with whistleblowers in a positive and productive way, and not the way I was dealt with. I simply tried to realize a better and stronger quality of life for those who were suffering. I was compensated with loses that will never be repaired or restored. Battered Woman Fights for Child Custody after Employment Whistleblowing Exposes Flaws in the Ruling

Michele Egan-Byron filed a petition in the U.S. state of Florida in mid-September to vacate an old order which had granted custody of her child to her ex-husband. Egan-Byron claims that she lost custody of her son after she exposed her employer’s embezzlement, which prompted colleagues to testify against her in the custody case. Egan-Byron claims that her ex-husband abused both her and their special-needs son. He won custody of the child in 2004 because of negative testimony that was given about Egan-Byron. She filed the petition in Florida's Palm Beach County asking for the court to take jurisdiction of the case from Volusia County, where Egan-Byron previously lived, and to vacate the old order. Whistleblower Claims Custody Verdict Was Reprisal

Run Date: 10/06/08 By Alison Bowen WeNews correspondent Plenty of women are whistleblowers. And plenty lose custody unjustly. But a case in Florida is a rare double whammy, Michele Egan-Byron says. She lost custody of her son after she exposed wrongdoing at work. (WOMENSENEWS)--Michele Egan-Byron filed a petition two weeks ago asking a state family court to vacate a four-year-old ruling awarding custody to her ex-husband. The lawyer who helped her file for a new hearing was arranged by U.S. Rep. Robert Wexler, a Democrat from Florida. It's rare that a public official takes an active role in a custody case but Egan-Byron's case is unusual: She says she lost custody of her son after she lost her job for revealing financial misdeeds in the workplace. Thus, hers is not only a custody case; it's a custody-injustice case combined with accusations of whistleblower backlash. She says reporting six years ago possible embezzlement at her employer--the AIDS Coalition of Volusia and Flagler County, a nonprofit that had about a dozen full-time staffers assisting patients in and around Daytona Beach--prompted angry supervisors and co-workers to testify against her during the court custody battle. Her ex-husband, who Egan-Byron said abused her and their son, including duct-taping the son to a high chair, won custody in 2004 after a former co-worker testified against her. The attorney who currently represents her ex-husband said she would not comment on the case. But her story began two years earlier, in 2002, when, in her first month as a caseworker for AIDS patients, Egan-Byron said she noticed money missing from patients' housing stipends. When she reported her suspicions to her supervisor and nothing happened, she brought them to the Volusia County Health Department. After that, she claims, she was attacked twice physically in her office, which she reported to the police. She was fired in December 2002 after six months on the job. Exposed Embezzlement at Nonprofit Beginning in the spring of 2005, Egan-Byron began talking to law enforcement agents investigating the embezzlement. The money turned out to be going to the father of a co-worker, Ebony Davis, who pleaded guilty to embezzling about $2,000. The AIDS Coalition of Volusia and Flagler County closed in 2006. Now Egan-Byron's custody petition asks a court in Florida's Palm Beach County, where she now lives, to take jurisdiction of the case from Volusia County, where she lived when she worked for the AIDS Coalition. She hopes new jurisdiction will help, because her credibility has been improved by the recent guilty verdict in the embezzlement case. "My allegations were validated and still that court would not send my son back," she said of her workplace allegations. "I think my client got shafted," said John Fenner, the attorney Wexler helped arrange for Egan-Byron. Fenner said Egan-Byron's credibility was undermined during the custody battle when her ex-husband's lawyer at that time used her allegations of embezzlement to make her look mentally unstable and no one investigated her claims. Now that her allegations are validated, he said, she deserves a second chance. "There's also a concern of how long do you keep this boy in the middle of a lawsuit?" After Egan-Byron's Sept. 17 petition was accepted, her ex-husband was notified by the court and has 20 days to respond. Egan-Byron hopes for a hearing date within the month. Retaliation Denied None of her former co-workers, including a massage therapist who testified against her mental condition, admit they were motivated to act by any retaliation, Egan-Byron said. Egan-Byron told Women's eNews about Wexler's help in July. She says she is exclusively telling Women's eNews her story because she wants other women to know what she went through and ensure it doesn't happen to another mother. "I had no idea my baby would be used like this," Egan-Byron said. "No mother would do anything like I did thinking that their child was in danger." When reached in August, Wexler aide Darcy Robinson Farnan confirmed the congressman's office has been helping Egan-Byron for years while she tries to retrieve custody. Wexler knew Egan-Byron through her previous work as an AIDS coordinator for the health department of Palm Beach County. At the time, he was an attorney interested in public health and frequently read about her work with HIV patients in the news. Wexler first intervened on her behalf in 2004, when Egan-Byron, desperate after losing custody of her son, began contacting politicians for help. Wexler, a "godsend," she said, helped her at a point when she was living in a homeless shelter. She lost her house and savings after paying for the court battles with her ex-husband. Wexler called the Department of Housing and Urban Development, which partially funded the AIDS Coalition, and vouched for Egan-Byron's claims. "He said, 'If Michele says there is embezzlement, then something is wrong,'" Egan-Byron said. Same Law Office for Both Cases After Egan-Byron reported the missing funds and was fired, her former husband filed for custody. On a visit to his lawyer's office, Egan-Byron realized her ex-husband was using the same law office that represented her former co-workers, the AIDS Coalition employees. Her status as a fired employee who raised allegations about her colleagues had become fodder for debate in the custody case. A judge transferred temporary custody to her ex-husband while she was recovering from surgery in the hospital, she said. The temporary custody became permanent this year. Egan-Byron did not see her son for three and a half years while he lived with his father in Crystal Lake, Ill., and accuses her husband and his lawyer of manipulating their son and influencing the outcome of the decision. In July 2007, her son, who is now 15, came to Florida for a 10-day visit filled with movies, dinners and bowling. She said her son is a special-needs child and suffers from the separation. Instead of staying in his bed, he slept on the floor outside her bedroom door each night, she said. "He stopped growing the day they took him," Egan-Byron said. Mo Therese Hannah, a professor of psychology at Sienna College in Loudonville, N.Y., is a leading advocate for the custody rights of battered women. She says politicians rarely help women with custody cases and she has never heard of a custody case with a whistleblowing element. However, Hannah added, "When people object and complain and do things to try and fight the system, often they've been retaliated against." Thank-you so much or the positive and loving thoughts.  What is so very upsetting is that Palm Beach County's Chief Judge in 1998, wrote an Administrative Order, 5.007 which deals with Petitions for Modification.  Modification for child custody, support and anything that is heard in Family Court.  The Order states:

Petitions for Modification must be filed with the clerk along with the appropriate filing fee, if applicable, and served on the opposing party. Such petition shall carry the same case number as the final judgment or order for which modification is sought, and shall remain assigned to the same division where that final judgment or order was obtained.

Not only did Volusia County and the six judges I went through as I jumped their judicial hoops, have no rights or venue or jurisdiction in my case this court used my former employer who embezzled my AIDS clients and patient's money and benefits, the attorney, Larry Nixon had his friend Judge Graham change the case number and no one would pay attention to me as they destroyed my life.  Larry Nixon even had the obscene and grotesque audosity to send Palm Beach County a letter instructing them NOT TO SEND THE ORIGINAL FILE TO VOLUSIA COUNTY, as he was proceeding with a new and fraudulent case.  I found out two years later what he had done.  I will post this disgusting letter.  I don't want money or "things", I want my son and my work and I want the the nation to know what happens to people like me when we step on the toes of scum with access to money, benefits and the strong desire to steal from those who have no quality of life, and basically try to live from day to day.  Unfortunately, and ironically that's how I have been living.

Thank-you, she is sitting in Coleman Federal Prison.  It only cost my clients and patients their benefits and my son and I 4 years of our lives.  If I sound bitter I am sorry, so much loss and pain because the Volusia County Health Dept didn't wan to be bothered, and the Volusia County Courthouse wasn't human enough to admit they made an obscene mistake.

I am so grateful for your thoughts and caring enough to read my site.  My prayers for your happiness is continuous.

Dear Ginny.

Thank-you for your kind thoughts, but I have to be very honest.  The AIDS Coalition of Volusia & Flagler Co.,The Volusia County Family (Kangaroo Court), The Health Planning Council of NE Florida, the late Larry Nixon, Esq, and the abusive ex who has a history of not only abusing me, but my son when he was an infant, took everything I ever worked for including my child. They do not and never did care about the clients and patients, they only cared about lining their pockets.  But the saddest thing is that no one from the community I so desperately tried to help improve the quality of their lives never ever contacted me to say "thank-you" for  advocating and standing up for us and all of the other loved ones in pain.  As far as that goes, I find it as obscene as anyone can imagine, (except for the pain I feel for my child,  using him to hurt me is the lowest anyone can ever go).

Thank-you so much for recognizing what I tried to do.  The best thing that came out of this sickness is the demise and closing down of The AIDS Coalition, the imprisonment of Ebony Davis and knowing she has been banned from ever working (?) in this field again.  Additionally my patients and clients will finally receive the benefits my colleagues and I worked so very hard for so many years ago.

I didn't even know what was going to happen, I didn't know he was going to be sent home. I believe you had something to do with it. Dear Indijah, You posted your message on July 21, that was the day I picked up my son from the airport. We hadn't seen each other in 3 & 1\2 years. I know all of your prayers for me were so strong that my prayer was answered on that same day. I feel stronger and more alive, and I am so grateful for your wishes and Blessings for me. Zak and I went to a place called Elwoods where he played drums with the band The Flyers. He is the youngest kid to play with a professional band on the strip (he's 14 now). Zak has always been very musically gifted. He received three standing ovations, and never played with the band before nor did he practice, he just knows the tunes. What has been robbed from us the past (almost) 4 years is too obscene to believe.
